In the March 20, 2026 edition of Massachusetts Lawyers Weekly, Managing Partner Erin Higgins shared insights on an Appeals Court decision affirming that a retired attorney could retain nearly $140,000 in fees, despite client allegations regarding the lack of detailed billing records. The article reads, “Erin K. Higgins, a professional liability attorney and managing partner at Conn Kavanaugh in Boston, says the Appeals Court was right not to hold against [the defendant] the fact that he hadn’t kept detailed billing records in his work.”
“My own experience representing lawyers at the Board [of Bar Overseers] is that this is frequently a misunderstanding that clients have where they agree to a fixed fee and then, if there’s a termination of the representation, they get angry if there’s not detailed time entries,” Higgins said. “But that is not something they bargained for.” For the entire article (subscription required): Click here
