Thomas J. Gallitano recently served on the faculty of a Massachusetts Bar Association seminar entitled It’s Confidential – Privilege Law in Massachusetts. Mr. Gallitano spoke on the application of the so-called Common Interest and Joint Defense Doctrines under Massachusetts law, with particular emphasis on how those doctrines relate to the attorney-client privilege, and on the circumstances under which those doctrines can be defeated to require an adversary in litigation to turn over documents that might otherwise be protected from discovery because of the attorney-client privilege.
