Leadership

Conn Kavanaugh attorneys hold leadership positions in many community and bar organizations, publish articles and speak at continuing legal education seminars. The Supreme Judicial Court of Massachusetts appointed one of our founding partners to the Massachusetts Board of Bar Overseers (BBO), the official body that investigates and evaluates complaints against lawyers.     Biography

    Michael is principally a trial and appellate litigator. In over 20 years of practice, he has handled numerous mediations, arbitrations, trials, and appeals, in state and federal courts, for individual and corporate plaintiffs and defendants, in a variety of complex and high-stakes disputes. He focuses primarily upon business litigation, with special emphasis on construction and property disputes, and professional liability. He also provides general legal counsel to businesses and individuals. Michael understands his clients and their industries, and he is committed to handling each matter creatively and economically, and with attention to its real-world impact.

    He has received the highest “AV” Peer Review Rating in the Martindale-Hubbell Lawyers Directory, and on multiple occasions he has been named a “Super Lawyer,” an honor delivered to just 5% of Massachusetts lawyers. He is committed to public service and improving the administration of justice, and he is Chairman of the Zoning Board of Appeals of the Town of Manchester-by-the-Sea, where he lives with his wife and two daughters.

    Representative Matters

    • Business Litigation

      • Filed suit and secured a payment of over $1M for a design-engineering firm whose fees in connection with major development-highway project had not been paid by the developer.
      • Defended an employee-placement company against a federal lawsuit alleging non-payment of commissions; successfully enforced nominal settlement on which plaintiff attempted to renege. 
      • Prosecuted a defective-software claim, and handled the resulting arbitration hearing in Japan, on behalf of a Massachusetts technology company against its Japanese subcontractor.
      • Defended the sponsor of a themed road race against a federal lawsuit alleging fraud and deceptive trade practices. 

    • Construction

      • Successfully defended a design-engineering firm against a property-damage lawsuit, obtaining a jury verdict against the plaintiff and legal-fee reimbursement from co-defendant. 
      • Obtained summary judgment for a design-engineering firm in two separate lawsuits alleging property damage and economic loss.
      • Filed suit and secured a favorable settlement for a housing cooperative that suffered extensive damages from hundreds of defective windows installed during a rehabilitation project. 
      • Filed suit and secured favorable settlements for the owners newly-constructed residences found to have major structural defects.
      • Defended a mechanical engineering firm against a federal case alleging over $10MM of design errors in a university science building; secured a modest settlement on eve of trial. 
      • Represented design-engineering firm in negotiations with a municipality over alleged defects in a new multi-million dollar water-sewer system.

    • Land Use / Real Estate Litigation

      • Successfully prosecuted claims for two property owners against tenants who misused the owners' properties, obtaining a jury-trial verdict and legal-fee reimbursement in each case. 
      • Successfully represented a supermarket in a lawsuit against a tenant who claimed it was entitled to a lease extension, obtaining a bench-trial eviction verdict and legal-fee reimbursement.
      • Successfully represented a local property owner against a Canadian tenant that vacated the property, securing a Massachusetts judgment and enforcing the judgment in Canada.
      • Represented sellers and buyers in separate lawsuits involving allegations of fraud and misrepresentation in connection with a residential sale.
      • Represented the owner of a prominent nightclub property in a lawsuit involving safety and liquor-licensing issues at the nightclub.
      • Represented various community groups and property owners in local board hearings and resulting appeals. 

    • Professional Liability

      • Successfully defended a podiatrist against a lawsuit alleging negligent treatment and serious personal injuries, obtaining a jury-trial verdict after week-long trial.
      • Defended numerous health care professionals against serious malpractice claims.
      • Represented an excess insurer of health care providers against multiple claims alleging catastrophic injury and resulting exposure to the excess insurer. 
      • Represented numerous attorneys and law firms against claims of legal malpractice.

    • Complex Tort Defense

      • Successfully defended a general contractor against three catastrophic personal-injury lawsuits, securing the settlement of each claim with no payment by his client and legal-fee reimbursement by other defendants.
      • Obtained summary judgment for a charcoal manufacturer alleged to have caused burn injuries to the guest of the charcoal's user, who improperly disposed of the charcoal.
      • Defended the manufacturer of rock-crushing machine in a lawsuit alleging catastrophic injuries, secured a favorable settlement before trial.
      • Defended a property owner against a premises-liability lawsuit alleging severe personal injuries and associated lost-earnings; handled related appeal concerning insurance-coverage issues. 

    • Appeals

      • Represented an insurance company, who prevailed in a state Supreme Court appeal, in a case of first-impression interpreting statutory insurance-payment requirements. 
      • Represented an insurance company, who prevailed in a state Supreme Court appeal, in a case involving the enforceability of unwritten settlement agreements.
      • Twice obtained a state appellate court affirmance of a trial court order granting summary judgment to a client design-engineering firm alleged to have caused property loss.
      • Co-represented the Lt. Governor of Rhode Island, who prevailed in a state Supreme Court appeal, in a case involving the Governor's ability to fill vacated general-state offices by appointment. 
      • Represented a property owner in a state court appeal and case of first impression that defined the state Housing Court's jurisdiction. 
      • Represented a physician in a state Supreme Court appeal involving the application of a statute to expert-trial witness qualifications.
